Court set to determine fate of interested parties and friends of the court in sterilization
Who: SWK, PAK, GWK, AMM, Kenya Legal and Ethical Issues Network on HIV & AIDS (KELIN) , African Gender and Media Initiative Trust (GEM) vs. Médecins Sans Frontières – France(MSF- France), Pumwani Maternity Hospital, Marie Stopes International, the Nairobi County Executive Committee Member in charge of Health Services, Cabinet Secretary – Ministry of Health, Republic of Kenya, The Attorney General.
What: Petition No. 605 of 2014: Ruling on the applications made by Professor Alicia Ely Yamin, the Joint United Nations Programme on HIV/AIDS (UNAIDS), and the National Gender and Equality Commission (NGEC) who seek to join the Petition as amicus curiae (friends of the court); while the International Community of Women with HIV – Global (ICW Global), and the International Community of Women with HIV – Kenya (ICW Kenya) seek to join as interested parties. It is noteworthy that all the above parties have already been enjoined in Petition 606 of 2014, which addresses similar issues on the forced and coerced sterilization of women living with HIV.
This ruling follows the directions previously issued by Justice Issac Lenaola for all the above five parties to file written submissions in support of their applications to be enjoined as either Friends of the Court or interested parties.
Why: Medicins Sans Frontiers – France, had opposed the applications to have the UNAIDS Secretariat, ICW – Global and ICW Kenya join onto the case. They raised several grounds in opposition with one of their key grounds being that the five organizations had not demonstrated that they will introduce any new arguments different from those already advanced by the parties.
