GEM Trust invites interested individuals to submit their expression of interest for consultancy to
develop the organisation’s Data Protection Policy. The policy is intended to help GEM Trust develop
appropriate mechanisms on how to handle the data it collects, to ensure compliance with data
protection laws and regulations, to protect the rights of the data subjects and protect the organisation
from risks related to breaches of data protection.
Scope of work
The consultant will undertake the following tasks; –
- Conduct a desk review of data protection laws in Kenya including Data Protection Act 2019, Kenya Information and Communications Act, 2015, Kenya Information and Communications (Consumer Protection) Regulations of 2010, Public Health Act 2012 ; Health Act, 2017; the HIV and AIDS Prevention and Control Act, 2006, National Payment System Act, 2011, National Payment System Regulations, 2014,Consumer Protection Act, 2012)
- Formulate a draft data protection Policy for GEM Trust
Outputs:
1. Draft Data Protection Policy for GEM Trust
2. Organise a training for GEM Trust staff and board on the draft data protection policy.
Duration
The assignment is expected to be undertaken for a period of fifteen days (15) days
spread from 18th December to 9th January 2024.
Consultancy Fees
The consultant will provide a financial proposal for the assignment in Kenyan
shillings which will be competitively evaluated and once agreed upon, a contract will be signed. A 5%
withholding tax will apply.
